Medical & Data Disclaimer
MedFind AI is an informational tool to assist licensed clinicians in identifying potential referral facilities. It does not provide medical advice, is not a substitute for professional judgment, and is not a medical device. The clinician remains solely responsible for all referral and clinical decisions.
Facility, insurance, hours, availability, and credential information is drawn from third-party sources and AI web search and may be inaccurate, incomplete, or outdated. You must independently verify all such information directly with the facility and payer before relying on it. The Service is not HIPAA compliant, offers no BAA, and must not be used with PHI or as a system of record.
1.Acceptance of these terms
These Terms of Service ("Terms") are a binding agreement between you and MedFind AI ("MedFind AI," "we," "us," or "our") governing your access to and use of the MedFind AI website at medfindai.com and the MedFind AI application at app.medfindai.com (together, the "Service"). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2.The Service & eligibility
MedFind AI is an AI-powered referral and facility-finder that uses mapping data and generative AI (including AI-powered web search) to surface information about medical facilities, such as location, insurance accepted, hours, and availability. The Service is intended for use by licensed healthcare professionals and other authorized users acting in a professional capacity. You represent that you are at least the age of majority in your jurisdiction and are authorized to enter into these Terms.
3.Not medical advice; clinician responsibility
The Service is an informational tool that assists clinical referral decisions. It does not provide medical, clinical, legal, or professional advice, does not practice medicine, and is not a substitute for the professional judgment of a qualified clinician.
The clinician (or other user) is solely responsible for all referral, treatment, and clinical decisions. Before relying on any result, you must independently verify all facility information — including insurance and plans accepted, hours of operation, current availability, services offered, licensure, and credentials — directly with the facility and/or the relevant payer. In an emergency, follow your local emergency protocols; do not rely on the Service.
4.Third-party data & accuracy; "AS IS"
Facility, insurance, hours, availability, and related information is derived from third-party sources and AI-generated web search, and may be inaccurate, incomplete, outdated, or otherwise unreliable. AI systems can produce errors or "hallucinations." We do not independently verify, endorse, or guarantee any facility, provider, or the information presented about them.
All content and results are provided "AS IS" and "AS AVAILABLE," without any warranty of accuracy, completeness, timeliness, or fitness for a particular purpose. You assume full responsibility for verifying information and for any decisions made using the Service.
5.No HIPAA compliance; no PHI
The Service is not HIPAA compliant, and MedFind AI is not a Business Associate and will not enter into a Business Associate Agreement (BAA). You must not submit Protected Health Information (PHI), patient-identifying information, or other regulated health data into the Service, and you must not use the Service as a system of record or for any purpose requiring HIPAA compliance. You are solely responsible for your compliance with HIPAA and all other applicable privacy and healthcare laws, and for ensuring that your inputs do not contain PHI. See our Privacy Policy for more.
6.Beta / proof-of-concept
The Service is currently offered as a beta / proof-of-concept and is provided for evaluation purposes. It may contain bugs or errors, may change or be discontinued at any time without notice, and may be unavailable, interrupted, or reset. Features, data sources, and these Terms may change as the Service evolves. We make no commitment regarding availability, uptime, data preservation, or continued operation.
7.Accounts & your responsibilities
You are responsible for the information you provide, for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account. You agree to provide accurate information, to keep it current, and to notify us promptly of any unauthorized use of your account. We may suspend or terminate accounts that violate these Terms.
8.Acceptable use
You agree not to:
- Use the Service in violation of any applicable law or regulation, including HIPAA and other privacy or healthcare laws;
- Submit PHI or patient-identifying information, or use the Service to make decisions requiring capabilities the Service does not provide;
- Reverse engineer, decompile, disassemble, scrape at scale, or attempt to derive the source code or underlying models of the Service, except to the extent this restriction is prohibited by applicable law;
- Interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service or its underlying systems or third-party providers;
- Resell, sublicense, or commercially exploit the Service without our prior written consent; or
- Use the Service to build a competing product or to infringe the rights of any third party.
9.Intellectual property
The Service, including its software, design, text, graphics, logos, and all related intellectual property, is owned by MedFind AI or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal professional purposes. All rights not expressly granted are reserved. "MedFind AI" and associated marks are our property; you may not use them without our prior written permission. Third-party data and map content remain the property of their respective owners.
10.Third-party services
The Service relies on third-party providers, including Google Maps Platform and Google Gemini (AI and web search). Your use may be subject to those providers' terms, and we are not responsible for third-party services, content, or data practices. Links or references to third-party facilities or resources are provided for convenience and do not constitute an endorsement.
11.Disclaimer of warranties
12.Limitation of liability
13.Indemnification
You agree to defend, indemnify, and hold harmless MedFind AI and its officers, directors, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms or applicable law, including any submission of PHI or violation of HIPAA or other privacy laws; (c) any referral, clinical, or other decision you make in connection with the Service; or (d) your infringement of any third-party right.
14.Governing law
These Terms are governed by the laws of the State of [State], and applicable U.S. federal law, without regard to conflict-of-laws principles. Subject to Section 15, the state and federal courts located in [State/County] will have exclusive jurisdiction over any dispute not subject to arbitration.
15.Dispute resolution & arbitration
Please read this section carefully. Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration administered by [Arbitration Provider] under its then-current rules, seated in [Venue], rather than in court, except that either party may bring qualifying claims in small-claims court. To the extent permitted by law, you and MedFind AI agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding. This section survives termination of these Terms. [Placeholder — arbitration and class-action-waiver terms subject to review by legal counsel.]
16.Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms. You may stop using the Service at any time. Upon termination, the license granted to you ends, and any provisions that by their nature should survive — including Sections 3–5 and 9–18 — will survive.
17.Changes to these terms
We may modify these Terms from time to time. When we do, we will update the "Last updated" date above and, where appropriate, provide additional notice. Changes are effective when posted. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
18.Miscellaneous
If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect (severability). Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them freely. These Terms, together with the Privacy Policy, constitute the entire agreement between you and MedFind AI regarding the Service and supersede any prior agreements.
